6. Figure delivery costs into your Tiffany product’s final price. If you’re spending a lot on your Tiffany the seller should insure it when it ships.
7. Never pay for your Tiffany product using instant cash wire transfer services through Western Union or MoneyGram – this way you’re protected if all seems to go wrong.

Imagine you are an unsuspecting buyer trolling around eBay.  You search and search and finally find what you’re looking for, a 1carat diamond ring.  Because eBay so highly recommends buying your merchandise through PayPal, you take eBay’s suggestion and buy the ring through PayPal.  You wait excitedly for your new ring to arrive. 

When the package arrives from the eBay seller, you refuse to sign for it.  It is obvious that one side has been slit and the package is empty.  When you contact the seller, he claims that it’s not his responsibility and refuses to refund your money despite the fact that said seller indicated he would buy shipping insurance on your ring. 

Although your feel that the best thing to do is to call the police and your credit card company and file a report immediately, you contact PayPal first.  PayPal tells you to hold off, let them try to resolve the issue before you contact your credit card company and go to the police.  Once contacted by PayPal, the seller files a counter complaint. 

You wait and wait and wait for PayPal to contact you about the issue.  When they finally do, they tell you to go ahead and call the police and your credit card company as there is nothing that they can do for you.  You think, “what about buyer protection?  What about eBay’s security and resolution center?” There is no one at eBay or PayPal to help.  They say it’s out of their hands.

Now this is not to say that all eBay sellers are corrupt.  Most eBay sellers are honest business people who want to make money and provide a good product, period.  However, eBay does nothing to screen its sellers.  Nothing.  As a result, buyers are left insecure about their transactions, honest sellers are mistrusted, dishonest sellers get away scott free.

Again, eBay is not held at all responsible for its bad, bad policies.

You have paid the copyright owner a good deal of money (which was NOT easy to come by) in order to sell these copyrighted items. You are a completely legitimate seller. You work hard. You are trying to make ends meet. Your business is not doing well despite the fact that you work over 70 hours a week. Why? You have a good product that people want. You have a fair price. There’s no reason why you shouldn’t be doing well.

Of course, there is a reason why you aren’t doing well. There are a number of reasons in fact. First of all, there are people selling fakes for much less. Second, there are so many instances of counterfeit merchandise on eBay that buyers simply do not believe that anything on eBay is legitimate. Third, eBay does nothing to remedy the situation. Buyers assume that ‘authenticated’ material is a sham and sellers are liars out to take advantage of them. Because of this, people buy the cheapest product out there, fake or not.

There is nothing you can really do about this. You’re not the only honest seller with this problem. You’re not the only seller losing money because of eBay’s negligence. Counterfeit items and buyer apprehension have become, most unfortunately an eBay phenomenon.

The idea is astounding really. If eBay doesn’t have the man power to check the auctions for legitimacy than how are you, small business owner that you are, going to be able to do it? It’s ridiculous.

With all the money eBay is reeling in, shouldn’t they hire a couple of trained individuals to check the auctions everyday? It would take no time at all for someone who knew what they were looking for. In the meantime, the small amount of monitoring eBay does is counterproductive as eBay’s untrained employees’ pull items from legitimate sellers. They just don’t know the difference between counterfeit and legal product and eBay’s policies DO NOT instruct employees to do any outside research such as verification of copyright ownership. Again, honest sellers AND buyers pay for eBay incompetence.

Our company is a perfect example of what is going on in eBay, of their negligence. We have authentically licensed How the Grinch Stole Christmas © and Pepsi © Italian charms in our stock. We have bought the rights to use these, to sell these. We paid a lot of money to be legitimate sellers of How the Grinch Stole Christmas © and Pepsi © Italian charms and yet it’s redundant for us to try to sell these charms on eBay.

Although we do have some How the Grinch Stole Christmas © Italian charms up for auction on eBay, we have learned that trying to auction Pepsi© Italian charms is simply pointless. There are too may dishonest Italian charm sellers out there who are selling fakes. We just can’t compete with their price.

If we point this out to eBay, they simply tell us that it is not their problem. Unless the copyright owners themselves bring it to their attention then there is nothing eBay is going to do about it. Of course, we’re small potatoes to the copyright owners. We could call them day in and day out to point out all the fraudulent merchandise on eBay, but to them, it’s not worth the time and effort. It’s only eBay.

Furthermore, eBay buyers are so distrustful of the auctions and claims of authenticity, how are they to know that our How the Grinch Stole Christmas © and Pepsi © Italian charms are authentic whereas the other charms for auction are not? The buyers themselves would have to do a great deal of research to determine what is and it not a legitimate How the Grinch Stole Christmas © or Pepsi © Italian charm. It’s all very ridiculous really.

Lastly, when eBay does get it in their head to do some monitoring, they don’t even check to see if a seller is legitimate or not before pulling their merchandise. If some trainee decides that he thinks out How the Grinch Stole Christmas© Italian charms might be an infringement upon copyright, he’ll just pull it without doing any research whatsoever.

In the end it is the legitimate sellers and unsuspecting buyers who suffer and it is all because eBay is negligent.

eBay is Not doing it’s job!

Somewhere along the line you realize that eBay is making money off legitimate and counterfeit sellers alike. If they did make the effort to monitor the auctions, they would ultimately lose money. Sellers of counterfeit materials have to pay dues too.

eBay knows that as long as they can continue to make buyers feel secure with offers of secure buying and buyer protection, then they can keep making money without losing their profits. In the meantime, they are doing nothing to protect either buyers or legitimate sellers.

eBay claims that they are tough on counterfeiters with their VeRO program, but really, they’re just out to make a buck and watch their own bottom line.

eBay does not care about buyers or legitimate sellers!

Imagine you’re a small business owner who sells your merchandise through eBay. You’ve got kids to support, a mortgage, car payments; you’re barely making ends meet despite the fact that you’re working 70 or more hours per week.

Imagine eBay pulls your auctions and suspends your account because a malicious competitor, customer, or corporate big wig claims you’re infringing upon a copyright when you’re not. Imagine the lost revenue. How are you going to pay for your groceries now?

This is what happens: someone files a report with eBay’s VeRO program claiming they think you’re infringing upon a copyright. They don’t have to prove anything. They just have to think your infringing. Well, eBay immediately pulls the products. Maybe they suspend your account too. You receive a brief notice from eBay letting you know what’s happened.

When you call VeRO, they inform that it’s your responsibility. You have to directly contact the people who filed the claim against you and have it out with them. Of course, since VeRO will not give out the accuser’s information, all you have is an e-mail address by with to contact this person/company. There is nothing, VeRO tells you, that they can do about it.

VeRO has no check and balance procedures in place. When VeRO receives a claim of copyright infringement, they do no work to ensure that the claim is valid.
Despite numerous days and e-mails to the accusatory party, you get no response. In the meantime, your income has been stopped in its tracks. Your innocent and you’re losing money with every passing hour. When you call VeRO again, they say they will take the case under consideration. Of course, your account will remain suspended in the meantime.

This is not the first time this has happened to you and you’re certainly not the only seller who has been faced with this problem. Companies and competitors file false claims against eBay sellers all the time. This is nothing new. The process is arduous and costly to innocent eBay sellers.

Many eBay sellers find accusations against them unfounded but take no action. Whether intimidated by the corporate monster, confused by the ethereal and complicated counter-notification process or simply disenchanted, eBay sellers frequently find themselves feeling helpless once their items are pulled or accounts suspended.

When, after however many days of stress and frustration, either VeRO decides that you were in the right all the time or the accusatory party decided they were mistaken and your account is reinstated, you find that there is little to be joyful about. You’ve been screwed. You’ve already lost a week worth of revenue (a quarter of your month’s salary), your wondering just how your going to afford little Johnny’s birthday present this year, and you know full well that you won’t receive so much as a sniffle of apology.

When eBay established VeRO in 1997, it did so in order to comply with the regulations of the soon to be established Digital Millennium Copyright Act or DCMA. Designed to protect against online copyright infringement, the DCMA included provisions under which companies like eBay would not be held accountable for fraudulent merchandise or copyright infringement upon their site.

Under the DCMA, all eBay (VeRO) has to do to keep its nose clean is pull any items that are claimed to be fraudulent. It doesn’t matter if the claims are true or not. It doesn’t matter if the seller loses income. It doesn’t matter if the seller is left with a marred reputation, VeRO has no responsibility to the seller at all under the DCMA and it doesn’t take any either.

Imagine you’re that eBay seller and your account it finally reinstated. Do you think the claim against you is going to be excused? Erased from your sellers record? Well it won’t. Even if an eBay seller is found innocent and the merchandise is reinstated, the record is not cleared. The eBay seller’s account will still show the claim of copyright infringement leaving the seller vulnerable to potential permanent shut down. On the other hand, VeRO members who make false claims again and again are not reprimanded in the least. In fact, they are free to bombard sellers with willy-nilly accusations as they please.

VeRO is unfair to honest, hard-working eBay sellers, if it doesn’t affect them (which it doesn’t), they simply don’t care. Furthermore, if you think eBay is going to change its policies anytime soon you’re kidding yourself.

If you’re an eBay seller you may as well just get accustomed to getting the shaft. It’s eBay’s way.

If an eBay seller’s merchandise has been pulled it is most likely because someone somewhere has claimed they have infringed upon a copyright. Now, this may or may not be true, but nonetheless, the merchandise is pulled. More often then not, the seller has used a term or phrase that a company claims to own a copyright to. If a seller, hoping to reduce the amount of times merchandise is pulled or account shut down, then asks for a list of copyrighted terms, eBay will direct him or her to a website.

As part of eBay’s VeRO program, VeRO members are allowed to establish their own pages laying out exactly what they consider to be an infringement upon copyright. eBay will not give you a list of terms and phrases which infringe upon copyright. Afterall, as we found, there are very few words and phrases which aren’t copyrighted. In fact, it seems that there is nothing one could possible write that would not infringe upon a copyright in some way or another.

No. eBay will not provide sellers with a list, so we decided to do it for you. We have compiled a list of all the terms and phrases which VeRO members claim infringe upon their copyrights. Copyrighted terms have been posted as a list and alphabetically. You will have to follow links to find all the terms. Keep in mind that this is not an extensive list. This is only the list of VeRO members’ copyrighted terms and phrases. There are many many more out there so be careful.
